New Highs Totals Expanded as Major Averages Ended Mixed

The major averages ended mixed on Tuesday and the session's volume totals were mixed, lighter on the NYSE, yet higher on the Nasdaq exchange as traders returned from the long Labor Day weekend. Advancers led decliners by a 3-2 margin on the NASDAQ exchange, however decliners led advancers by a narrow margin on the NYSE. There were 88 high-ranked companies from the CANSLIM.net Leaders List that made new 52-week highs and appeared on the CANSLIM.net BreakOuts Page, up from the prior session total of 50 stocks. New 52-week highs expanded and solidly outnumbered new 52-week lows on the NYSE and on the Nasdaq exchange. There were gains for 11 of the 13 high-ranked companies currently included on the Featured Stocks Page. The broader market (M criteria) has been in a "confirmed uptrend" while leadership (stocks hitting new 52-week highs) has remained healthy. Remember that disciplined investors buy stocks with superior fundamentals only after they have triggered a proper technical buy signal.
PICTURED: The tech-heavy Nasdaq Composite Index rose 17 points to 4,598 hitting new 2014 highs with higher (near average) volume behind the gain.
Stocks took a breather on Tuesday. The Dow declined 30 points to 17,067. The S&P 500 fell from a fresh record high as it gave up less than 2 points to close at 2,002. Equities finished mixed as investors grew cautious ahead of an ECB meeting and monthly employment report later this week.
The latest economic data was encouraging. The ISM's manufacturing index unexpectedly increased last month to the highest level since March 2011 and construction spending jumped in July by the most in more than two years. In addition, the final reading on Markit's manufacturing PMI for August was revised slightly lower, but is at its best level since April 2010.
Overall, sectors were mixed. Energy was the worst performing group as WTI crude prices fell for the first time in five sessions. Chevron (CVX -1.48%) declined. Utilities also weighed on the market as Exelon (EXC -1.77%) dropped. Consumer stocks were mixed. Home Depot (HD -2.02%) fell after saying it is investigating a possible data breach. On the upside, Staples (SPLS +8.13%) rallied following positive analyst comments. Financials advanced, led by Bank of America's (BAC +1.12%) gain.
Treasuries retreated. The 10-year note declined 21/32 to yield 2.42%. The 30-year bond fell by nearly two full points to yield 3.17%.

Financial Groups Rose and Commodity-Linked Groups Fell

Financial shares helped the major indices as the Bank Index ($BKX +0.57%) and the Broker/Dealer Index ($XBD +0.60%) both had a positive bias. The Semiconductor Index ($SOX -0.42%) lost ground while the Networking Index ($NWX -0.01%) finished flat and the Biotechnology Index ($BTK +0.13%) eked out a tiny gain. The Gold & Silver Index ($XAU -3.47%) was a clear laggard as it suffered a large loss. Energy-related shares also fell as the Oil Services Index ($OSX -1.12%) and Integrated Oil Index ($XOI -0.89%) lost ground.

Churning Action Indicative of Distributional Pressure

Taro Pharmaceutical Inds (TARO -$1.41 or -0.87% to $159.75) churned above average volume at its 52-week high today and finished near the session low with a loss, a sign of distributional pressure. It has been repeatedly noted - "Extended from any sound base. Recently reported earnings for the Jun '14 quarter below the +25% minimum earnings guideline (C criteria) raising fundamental concerns."
TARO found support at its 50-day moving average (DMA) line and rallied to new highs since last shown in this FSU section on 8/06/14 with annotated graphs under the headline,"Still Building on an Advanced Base Pattern". It traded up as much as +40.1% since first featured in yellow in the 6/26/14 mid-day report at $117.31. Members were previously reminded - "The investment system rules say a stock should be held a minimum of 8 weeks after rising more than +20% in the first 2-3 weeks from being bought." In this case the stock went on to make further progress even after the company reported earnings -18% on -15% sales revenues for the Jun '14 quarter raising fundamental concerns with earnings below the +25% minimum guideline (C criteria).
The Israel-based Medical - Generic Drugs firm has seen the number of top-rated funds owning its shares rise from 2 in Mar '12 to 54 as of Jun '14, a reassuring sign concerning the I criteria. TARO has a small supply (S criteria) of only 44.3 million shares outstanding, which is favorable, however any institutional buying or selling could lead to great price volatility. Disciplined investors who may still be giving it the benefit of the doubt should be watchful for any damaging sell signals which would prompt them to lock in gains.
